The Mexico trademark law adopts the "first-to-file" basis. Prior trademark applicants are eligible for trademark registration. The trademark authority is Instituto Mexicano de la Propiedad Industrial (IMPI).

There are two ways to apply for a trademark in Mexico: 1. Single country application; 2. Designation of Mexico as one of the applying countries through the Madrid trademark.

The Mexico trademark application period is about 12-24 months. If there are other procedures such as oppositions and the applicant needs to reply. Therefore, the application period will be extended. Mexico trademark application process

STEP 1. Application
After submitting the required documents and fees, the application receipt will be obtained within 3 weeks. (※When submitting the application, the date of first use in Mexico must be provided)

STEP 2. Examination
The examiner will conduct a formal examination of the submitted application documents. If there is any discrepancy, the examiner will issue a "correction notice". Gold Kenn recommends that the applicant make corrections within 4 months.
After the formal examination, the examiner will conduct a substantive examination of the application for trademarks for unregistrable reasons. If there are unregistrable reasons, the examiner will issue a "Preliminary Notice of Rejection" and the applicant must reply within 4 months.

STEP 3. Announcement and Registration
After the substantive examination, if there is no reason for unregistrable or the defense is successful, the official will conduct a 3-month notice opposition period. After the announcement period ends, if no objections are raised, the official will issue a registration certificate.

Notices:
1. The trademark is valid for 10 years from the date of application and could be renewed for 10 years before the expiry date. The renewed date starts from the 6 months before expiration and is graced to within 6 months after the expiration.
2. It should be provided evidence of trademark use when applying for renew.
3. After 3 years from the date of registration, within 3 months, the trademark owner needs to submit proof of effective use of the trademark. If not submitted, the trademark registration will automatically become invalid.
4. If the trademark is not used within 3 years from the date of registration, the interested party may propose a trademark cancellation procedure.
